FYT AI, Inc. – Terms of Service

These Terms of Service (“Terms”) constitute a binding agreement between you (“User,” “you,” or “your”) and FYT AI, Inc., a Delaware corporation (“FYT,” “we,” “our,” or “us”). These Terms govern your access to and use of FYT’s products, services, applications, websites, and any associated software or features (collectively, the “Services”).
By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use the Services.

1. Description of Services
FYT provides a digital fitness ecosystem that includes, without limitation: The FYT mobile application and FYT Score performance testing platform; Artificial intelligence (AI)–powered fitness coaching, movement, and nutrition analysis; Integration with health and wearable data (e.g., Apple Health, Google Fit); and FYT-branded merchandise, subscription-based features, and related offerings.
The Services are intended solely for personal, non-commercial fitness and wellness use. FYT does not provide medical advice, diagnosis, or treatment. You acknowledge and agree that any information or guidance provided through the Services is for general informational and educational purposes only. Always consult a physician or qualified healthcare provider before beginning any new fitness or nutrition program.

2. Eligibility
You must be at least sixteen (16) years of age to access or use the Services. If you are under eighteen (18), you must have the consent of a parent or legal guardian to create an account and use the Services. By using FYT, you represent and warrant that you meet these eligibility requirements.

3. Account Registration and Security
To use certain features of the Services, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to maintain and promptly update such information as necessary. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to immediately notify FYT of any unauthorized use or suspected breach of security. FYT shall not be liable for any loss or damage arising from your failure to protect your account credentials.

4. Subscriptions, Fees, and Payments
FYT offers both a free tier and one or more paid subscription tiers (“FYT Pro”). Subscription fees, renewal terms, and payment methods are disclosed at the point of purchase. By subscribing to FYT Pro or any paid feature, you authorize FYT (or its designated payment processor) to charge your selected payment method for recurring fees until you cancel. You may cancel at any time through your app store account settings. All fees are non-refundable except as required by applicable law. FYT reserves the right to modify pricing, features, or subscription plans with reasonable notice to users.

5. Acceptable Use
You agree to use the Services in compliance with all applicable laws and these Terms. You shall not, directly or indirectly: a. Use the Services for any unlawful, fraudulent, or harmful purpose; b. Interfere with or disrupt the integrity, operation, or security of the Services; c. Attempt to access any data or systems without authorization; d. Copy, reverse engineer, decompile, or attempt to derive the source code of any software within the Services; e. Upload, post, or transmit any content that is defamatory, obscene, harassing, or otherwise objectionable; or f. Misrepresent your identity or affiliation with any person or entity. FYT reserves the right to suspend or terminate access to any user who violates these provisions.

6. Data, Privacy, and User Content
Your use of the Services is also governed by FYT’s Privacy Policy, which explains how we collect, use, and safeguard your personal information. By using the Services, you grant FYT a limited, non-exclusive, royalty-free, worldwide license to use, store, process, and analyze your data solely for the purpose of providing and improving the Services. This includes movement data, camera input, AI-based analyses, and integration with health data sources (such as Apple Health or Google Fit), subject to your consent. You retain ownership of any personal data and content you provide through the Services. FYT does not sell personal data to third parties.

7. Artificial Intelligence Features and Limitations
Certain Services incorporate artificial intelligence models to provide fitness and nutrition insights. You acknowledge and agree that: AI-generated recommendations are informational and not a substitute for professional medical advice; AI outputs are probabilistic and may contain inaccuracies; and You assume full responsibility for decisions made based on AI-generated information. FYT disclaims all liability for reliance on AI outputs for medical or health-related decisions.

8. Intellectual Property
All content, software, design, trademarks, and intellectual property related to the Services — including but not limited to the FYT name, FYT flame logo, FYT Score, and related branding — are owned or licensed by FYT AI, Inc. Except as expressly permitted, you may not copy, modify, reproduce, distribute, or create derivative works from any part of the Services without prior written consent.

9. Disclaimers and Limitation of Liability
The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied. FYT disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, FYT and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or goodwill, arising out of or related to your use of the Services. FYT’s total liability for any claim arising under these Terms shall not exceed the amount paid by you (if any) to FYT during the twelve (12) months preceding the event giving rise to such claim.

10. Termination
You may terminate your account at any time by deleting your account through the App or contacting support@getfyt.ai. FYT may suspend or terminate your access to the Services if you violate these Terms or if continued use poses a risk to FYT or other users. Upon termination, all provisions that by their nature should survive shall remain in effect, including ownership rights, disclaimers, and limitations of liability.

11. Modifications to the Terms
FYT reserves the right to modify or update these Terms at any time. Any material changes will be communicated through the Services or via email. Your continued use after such updates constitutes acceptance of the revised Terms.

12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
